Comedian Pengle, ex-wife clash over Homa Bay home ownership, court rules joint claim stands

Popular comedian Geoffrey Omondi alias Pengle and his former wife Richline Ondiko are in court over ownership of their matrimonial home in Komenya village, Rangwe Constituency of Homa Bay County.

Richline has gone to court seeking to have Omondi permanently barred from accessing the home. She also wants the court to order the former husband to cease harassing and issuing threats against her, home caretaker and servants.

In her testimony, Richline says she inherited the land from her late father. She then constructed a house without Omondi’s support. She further stated that Omondi and her were married but they later separated.

She denied any monetary or social contribution by Omondi towards the construction of the home. 

In his defense, Omondi admitted that Richline and him were married but they divorced. According to Omondi, he bought the land from Silas Owiti, who was Richline’s witness in the case.

Moreover, Omondi maintained that he purchased most of the construction materials, adding that a title deed of the land was issued on October 12, 2022.

Omondi, who was represented by lawyer Nancy Nyarige, prayed for division of the property for peace to prevail.

In her judgment, Chief Magistrate Jecinta Orwa ruled that Richline failed to prove her case against Omondi on a balance of probabilities. Thus, the contested property still belongs to both of them.

“The suit as filed against the defendant is struck out with costs to be borne by each party, taking into account the relation that existed between them,” Orwa conclude.

Despite the ruling, Omondi complained that certain individuals wanted him out of the property, which he swore to protect.  

The comedian vowed he will not hide and he was ready to face the people who want to violate his rights.

“This is my home and it will remain my home. I am not hiding,” he added.
